FCP text generator not broadcasdt legal?

Is the basic white text generated by FCP not broadcast legal by default.
Whenever I do "range check/excess luma" I always get the exclimation point.
Is this normal ? Does FCP's text always have to have the "broadcast legal" filter applied to it ?

What version of FCP are you using? What's white set to in video processing?

Process Maximum white as: "White"

Don't know. Mine maps the white to 100%. It does use 255s though for white, which generally isn't considered good practice.
Title 3D also maps to 100%, but uses 235s for white.
